Definitions
Pawesome Prints
Part of Honk6, established at Hooidonk 6, 3823 AL, Amersfoort, the Netherlands, and registered with the Chamber of Commerce under number 90977807.
Customer
Any natural person or legal entity entering into an agreement with Pawesome Prints.
Consumer
A natural person who is not acting in the course of a profession or business and who enters into an agreement with Pawesome Prints.
Agreement
The arrangement between Pawesome Prints and the customer for the delivery of products or services.
Applicability
These terms and conditions apply to all quotations, offers, deliveries, agreements, and services of Pawesome Prints, unless otherwise agreed in writing.
Any deviating terms and conditions of the customer are expressly rejected unless agreed otherwise in writing.
If one or more provisions of these terms and conditions are wholly or partially void or annulled, the remaining provisions shall remain fully applicable.
Prices
All prices are stated in euros and include VAT, but exclude any additional costs such as shipping fees or taxes, unless stated otherwise.
Pawesome Prints reserves the right to change prices and rates, including adjustments due to price index changes or increased costs from third parties.
If a price change occurs after the agreement has been concluded, the consumer has the right to terminate the agreement, unless the price increase results from a legal obligation.
Samples and Models
Displayed samples, models, or examples of products are for illustrative purposes only and may differ from the actual product, unless explicitly agreed otherwise.
Payments and Default
Payment must be made within the indicated payment term as stated on the invoice, unless agreed otherwise in writing.
If the payment term is exceeded, the customer is automatically in default and Pawesome Prints is entitled to charge interest of 2% per month from the due date.
Extrajudicial collection costs in the event of late payment are borne by the customer and calculated in accordance with applicable Dutch legislation.
Pawesome Prints reserves the right to suspend the execution of the agreement until full payment has been received.
Retention of Title
Pawesome Prints retains ownership of delivered products until the full purchase price has been paid.
The customer is not entitled to transfer, pledge, or otherwise encumber the products before full ownership has been transferred.
In the event of default or suspicion of insolvency, Pawesome Prints is entitled to reclaim the delivered products.
Right of Reclamation
In case of non timely payment, Pawesome Prints reserves the right of reclamation on delivered products as provided in the Dutch Civil Code.
The right of reclamation may be exercised in writing or electronically, after which the customer is obliged to return the products upon first request.
Delivery and Delivery Time
The delivery times provided by Pawesome Prints are indicative and do not entitle the customer to compensation in case of delay, unless agreed otherwise in writing.
Delivery takes place at the address provided by the customer.
If the customer provides an incorrect address, additional costs may be charged.
If payment is not made on time, delivery may be suspended.
Risk and Insurance
The risk of loss, damage, or depreciation transfers to the customer once the products have been delivered.
If the customer arranges transportation independently, the risk transfers at the moment of actual transfer to the customer or a designated third party.
Right of Withdrawal
Since most products of Pawesome Prints are custom made and produced according to the customer’s specifications, no statutory right of withdrawal applies.
For personalized products, the customer receives a preview for approval in advance.
The customer has 2 hours to cancel the order free of charge. After this period, design costs of €7.95 will be charged.
Warranty and Complaints
Pawesome Prints guarantees that delivered products conform to the agreement and the specifications provided.
Complaints regarding defects must be submitted in writing within one month after discovery, including a detailed description.
If a complaint is found to be justified, Pawesome Prints will, at its discretion, repair, replace, or refund the product.
For consumers, a notification period of 2 months applies for reported defects.
Liability
The liability of Pawesome Prints is limited to direct damage resulting from intent or deliberate recklessness.
Pawesome Prints is not liable for indirect damage, consequential damage, loss of profit, lost savings, or business interruption.
Liability is in all cases limited to the invoice amount of the agreement.
Force Majeure
Pawesome Prints is not liable for damage resulting from force majeure, including natural disasters, pandemics, government measures, business interruptions, and similar events.
In case of force majeure, obligations are suspended. After a period of 30 days, the customer may terminate the agreement in writing.
Right of Retention and Suspension
Pawesome Prints reserves the right to retain goods belonging to the customer until all payment obligations have been fulfilled.
If the customer is not a consumer, they waive the right to suspend performance of their obligations or offset any counterclaims against Pawesome Prints.
Amendment of the Agreement
If changes or additions to the agreement are necessary for proper execution, the parties shall amend the agreement in mutual consultation.
Amendment of the Terms and Conditions
Pawesome Prints may amend these terms and conditions. Essential changes will be communicated to the customer in advance.
After an essential amendment, the customer has the right to terminate the agreement if the changes are unacceptable.
Applicable Law and Competent Court
These terms and conditions and all agreements between Pawesome Prints and the customer are governed by Dutch law.
Any disputes shall be submitted to the competent court in the district where Pawesome Prints is established, unless mandatory law provides otherwise.
